Welcome to the MyTelemedicine, Inc. (“MTM”) website (the “Site”). MTM provides online health-related services by arranging for smartphone (video-telephone) medical consultations and secure web-based consultations with a licensed physician, arranging for electronic medical record storage by the physician, providing certain online health-related information, arranging for a prescription service by the physician, and offering certain other related products and services — which may include health & wellness newsletters and tracking data from remote monitoring devices for chronic conditions such as diabetes or hypertension (collectively, the “Services”).

As used in these Terms and Conditions, references to “MTM” mean and include MTM, its parent, subsidiaries, and affiliated entities. References to “you” or “your” mean you, your dependent(s), if any, and any other person accessing your MTM account.

These Terms and Conditions apply to your use of the Site and, to the extent referenced, to your registration for, subscription to, and use of MTM Services.

MTM Services do not include the provision of medical care by MTM. However, the Services include MTM facilitating a user, or member, to access licensed physicians who agree to consult with patients.

Access to these healthcare providers is through affiliates of MTM that provide communications access to physicians licensed in the state where you, the user, are physically located at the time of the consultation.

MTM arranges for, and facilitates, the provision of medical care; however, MTM does not provide medical care.

MTM hereby grants you a limited, revocable, non-transferable, and non-exclusive license limited solely to viewing or downloading a single copy of the material on the Site and to use the MTM software to the extent necessary to use MTM Services solely for your personal use.

With the exception of your Electronic Medical Records, MTM retains all right, title, and interest in and to the Site, the Services, and all related software, content, trademarks, and materials. Nothing in these Terms transfers to you any right, title, or interest in such property except for the limited license expressly granted above.

You may not reproduce, republish, distribute, modify, create derivative works from, publicly display, or otherwise exploit any portion of the Site or Services except as expressly permitted by these Terms.

To use certain Services, you must register and create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify MTM immediately of any unauthorized use of your account.

The Services are not intended for medical emergencies. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

Health-related information available through the Site is provided for general informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment from the consulting physician. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Your use of the Site and Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal and health information. By using the Services, you consent to the practices described in the Privacy Policy.

The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, MTM disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

MTM does not warrant that the Site or Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

To the fullest extent permitted by applicable law, MTM and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of, or inability to use, the Site or Services.

MTM may revise these Terms and Conditions at any time by updating this page. Your continued use of the Site or Services after any such change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
